This is a binding User Agreement ("Agreement") between Enable Biosciences Inc (referred to as "Enable Biosciences," "we," "us," or "our") and you-the account creator (referred to as "you" or "your"). When you ("User") click on the box or send in your sample, you agree that you have carefully read and understood this document thast contains Enable Biosciences Inc Terms and Conditions, including our Privacy Policy and Authorization for Release of Personal Information. Use of Service and Site

Enable Biosciences offers a service to its Users (Users with good standing and who have established an account) to purchase or utilize the laboratory. Purchase-related services, using at-home testing kits which they order or request online using our website ("Site"), to provide results of the tests from the biological samples collected by the registering User, and, optionally (where and when available), to purchase or request a follow-up consultation with a physician (collectively, the "Services"). Our services are available to any minor with consent from a legal guardian/parent. Parents/legal guardians will create an account and order tests on behalf of their minors.

ACCESS

Subject to your compliance with the terms of this Agreement, Enable Biosciences gives you a non-exclusive, limited, non-transferable, personal, terminable right to use and access the Site Services solely for your individual information in compliance with our terms and conditions.

User Accounts

You are liable for keeping your account login details like password and username or account information on the Site confidential. You are responsible for limiting your PC access, and you consent to acknowledge accountability regarding all actions that happen within your account. You agree to:

• Correct and valid registration details as requested by Us

• Update us in case of any changes to your registration information, including, without limitation to your email or residence address.

Services

A licensed physician, nurse practitioner, or physician assistant (referred to as "clinician or clinicians") reviews all User test requests. Physician assistants and nurse practitioners work under licensed physician supervision. Test kits are mailed to you after authorization by a nurse practitioner, physician assistants, or licensed physician.

Users pick their desired test kit on our website. The kit is mailed after review and authorization by our licensed clinician. After receiving the kits, you collect your biological sample(s), including all relevant information, and send the completed test kit to our testing labs. Any incomplete information or documentation may lead to your samples not to be tested. Biological samples solely include human fluids or tissue samples based on the test bought intended to be analyzed for individual use and not for any other reason including, but not limited to research, commercial use, publications, or any other reason other than the intended purchaser's wellness. Results are sent to health consultants for review, and after reviewing, they send the test result back to us. We provide the results to you in a more straightforward format through our Site. Suppose your test results are clinically essential or beyond our reach; when applicable, a health consultant will make a reasonable effort to reach you. We likewise share the results with your insurance company under whose program you are accessing the test and the provider you designated during account registration.

We try as much as possible to avoid any technical errors; however, few samples are less viable by the time they arrive in our labs, and analysis may fail.

You may purchase an additional or separate consultation with a clinician for an additional fee ("Consultation Fee") via the website. You may also acquire other services or goods from third-parties that we avail to you. We are not responsible for the loss or accuracy of any content, services, and goods provided by third parties through our website.

Payment and Fees

When and where necessary, a user insurance company can provide testing to you (User) at an applicable copayment or no fee at all. Likewise, we give you the option to purchase testing outside your insurance.

Feedback and Content You Give Us 

By showing, posting, or submitting content of any type ("User Content"), you Represent and guarantee:

• You are the owner or creator of and have the needed licenses, privileges, and consent to utilize and to approve Enable Biosciences or other users to share and use your User Information as required exercising the rights approved by you in this agreement and through the contemplated way by this agreement and us.

• Warrant you are liable for everything "User Content" that you post on our website. You consent to provide separate permission for the release of PHI before using our services. You allow us to agree to our laboratory or clinicians and comprehend that they can request additional documents permitting them to disclose your personal information. Also, you understand that once we disclose your data, federal privacy laws can no longer prevent your data disclosure. Clinicians and any other individual you authorize will have access to your data. You are not supposed to transfer or assign this agreement or any obligation hereunder without prior written permission from us. Any violation in transfer or assignment of this agreement by you shall have no effect or power.

You understand that we might receive, process, access, transmit, disclose or store individual data including private Information and Information enclosed by the Authorization for Release of PHI on or from our services or third-party providers, which can either be within or outside of the US We use different measures to protect your data within the United States, but for other countries, laws on the protection of your information may differ from the US laws. Intellectual Property Rights

We reserve ownership rights to all intellectual property and other privileges in the website, including but not explicitly limited to this agreement, design, software, links, content, and the like will remain with our licensors and us as required. All content on our Site is protected by copyright and is our property. Site elements like logos are protected by trademark, trade dress, unfair competition, and different federal or state laws, and copy any part of the whole is prohibited by any means.

BY CLICKING ON THE "I have read and agree to Enable Biosciences' Terms and Conditions, Privacy Policy, and Authorization for Release of Personal Health Information" ON ENABLE BIOSCIENCES ACCOUNT REGISTRATION SECTION ON THE SITE OR BY SENDING IN MY SAMPLE REQUEST, I SIGNIFY THAT I HAVE READ THROUGH AUTHORIZATION FOR RELEASE OF PHI CONTENT AND HEREBY AUTHORIZE ALL HEALTHCARE PROVIDERS, INCLUDING ENABLE BIOSCIENCES AGENTS, STAFF, PHYSICIANS, DESIGNEES ("HEALTH FACILITATORS"), AND ENABLE BIOSCIENCES LABORATORIES, INCLUDING BUT NOT LIMITED TO ENABLE BIOSCIENCES DESIGNEES ("LABS"), STAFF, AGENTS, AND PHYSICIANS THAT CARRY OUT SERVICES REQUESTED BY COMPANY AND USER.

Disclosure and Use of My Personal Health Information (PHI)

This authorization of PHI applies to sharing and utilizing all information in request(s) given by me or for me with my permission and the lab test results/data/values from such request(s).

I allow the release and transfer of such data to, among, and between myself and the following individuals/organizations and their staff, associates, agents, representatives, and designees:

1. Enable Biosciences, Inc;

2. Your and/or our insurance company;

3. any physician that you designate;

4. Health Facilitators and Labs; and

5. Other Company associates for the reasons herein and as necessary or allowed by law.

Subject to this authorization, the information might be shared or used for the following reasons:

• To facilitate and complete services requested by me or performed with my permission ("including receiving, reviewing, and approving test requests and reviewing, processing, and delivering the test values/results");

• For healthcare treatment and operations, or paying for services.

• ForTo research statistical studies as either or both identified or de-identified test resultsusing "de-identified" test results; or as

• State or Federal law allows.

I may choose not to allow my personal information to be used or shared for reasons explained above. Before I decide to opt-out, I must give a prior written notice request to the company as described below. I comprehend that this can affect the delivery of services I have willingly accepted to receive.

This authorization is proof of my informed choices to permit the release and disclosure of my information to the parties referenced above. I accept to have Enable Biosciences Inc contracted clinician(s) contact me regarding my tests, order, or results. Since their practice of this action ("Practice") is a telehealth service, I comprehend the healthcare practitioners or clinicians giving me services might use a telehealth or internet platform to contact remotely from my geolocation.

I understand that telehealth is also subject to medical data protection and secrecy and that no identifiable data collected during telehealth sessions with the practice will be shared with non-covered organizations/individuals according to HIPPA without prior written permission.

I understand and acknowledge that:

• This is a notice of our privacy practice copy.

• This "Notice of Privacy Practices" is anticipated to give information about how healthcare providers, practice, and contractors can use or share protected health data about me.

• Allow Practice and Enable Biosciences Inc to value patient confidentiality and do not sell phone numbers, email addresses, or utilize them other than for reasons outlined herein.

• I can opt-out or terminate this authorization on Enable Biosciences as described above.

Neither practice nor Enable Biosciences Inc has accustomed my treatment on the terms of these authorizations. All the information given is correct to the best of my knowledge. I will be responsible for any omissions or errors during completing this form and won't hold Biosciences Inc, Practice or its health care providers, or either of their employees accountable for my mistakes.
